Terms of Service

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.
1. About ShipVia Couriers

ShipVia Couriers is an online shipping rate comparison and label purchasing platform. We enable users to compare courier rates and purchase shipping labels provided by third-party carriers through technology integrations.
ShipVia Couriers is not a carrier, freight forwarder, warehouse operator, or logistics service provider. We do not transport, handle, store, or deliver shipments.

2. Eligibility and Account Use

You must be at least 18 years old to use the Platform. You are responsible for maintaining the accuracy of your account information and for all activities conducted under your account.

3. Shipment Information and Accuracy

You are solely responsible for providing accurate shipment details, including but not limited to:

  • Weight and dimensions

  • Origin and destination addresses

  • Declared value and contents

Carriers may apply adjustments or surcharges for incorrect shipment details. Any such charges will be passed on to the customer.

4. Shipping Labels and Carrier Services

All shipping services are provided by third-party carriers, subject to their individual terms, conditions, and liability policies.

  • Carrier tracking, delivery timelines, and service levels are determined solely by the carrier

  • ShipVia does not guarantee delivery dates, transit times, or service outcomes

5. Rates, Fees, and Payments

Shipping rates displayed on the Platform are provided by carriers via technology integrations and may change until label purchase is completed.

  • All fees are displayed prior to checkout

  • Shipping label purchases are generally non-refundable once issued, unless otherwise stated

6. Package Protection and Insurance

ShipVia may offer ShipVia Package Protection as an optional add-on.

  • When purchased, ShipVia Package Protection Terms & Conditions apply and prevail over standard carrier liability

  • Package Protection fees are non-refundable

If Package Protection is declined, shipments are subject only to the carrier’s default coverage and liability terms. ShipVia does not assume responsibility for loss or damage.

7. Claims and Compensation

Claims for loss or damage must follow carrier or Package Protection procedures
ShipVia may assist in claim submission as a facilitating platform only
Claim approval and compensation decisions are made solely by the carrier or protection provider
Compensation is payable to the customer only if and after ShipVia receives funds from the carrier or provider

8. Prohibited Shipments

You agree not to ship prohibited, restricted, or illegal items. You are responsible for complying with all applicable laws, regulations, and carrier policies.

9. Limitation of Liability

To the maximum extent permitted by law:

  • ShipVia shall not be liable for indirect, incidental, or consequential damages

  • ShipVia’s total liability shall not exceed the fees paid to ShipVia for the applicable transaction

10. Indemnification

You agree to indemnify and hold harmless ShipVia, Shipnovia Group Inc., and their affiliates from any claims arising out of your use of the Platform or violation of these Terms.

11. Termination

We reserve the right to suspend or terminate access to the Platform at any time for violation of these Terms or misuse of the Platform.

12. Governing Law

These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict of law principles.
